Subject: India Regulatory Changes – Sea Cargo Manifest and Transshipment Regulations (SCMTR) Extended Effective to 1st April 2021 – 8th Update
With the latest Circular No.43/2020 by Central Board of Indirect Taxes and Customs (CBIC) extending the effective of the Sea Cargo Manifest and Transshipment Regulation (SCMTR) to 1st April 2021, we will start the parallel run per order with below details.
Implementation
- Effective date given by CBIC is extended to 1st April 2021, due to disruption of Covid-19.
- Per Appendix A of Circular, Mandatory Filing Requirements on Parallel Basis for SAM and SDM starting from 1st November 2020
- Fine tuning of new system and new process has been taken place before effective.
- Penalties varying from INR 50,000 to INR 200,000 will be imposed for any incompliance on or after 1st April 2021.
- Trial run for our CIVS and KCIS service from Asia to India to be maintained before the ordered parallel run.
Sea Arrival Manifest (SAM) – For all containers into India:
- SAM to be filed in customs before vessel getting departed from Last foreign port of call. Example for KCIS & CIVS westbound, Port Klang is the last foreign port of call, while Dar Es Salaam for GIA northbound
- Shipping Instruction Cut off time at POL must be strictly adhered
- All containers discharging for local or transhipment or retain on board at any Indian Ports.
- Harmonized (HS) Code of 6 digits is mandatory
- IEC Code & GSTIN Number for Indian entity is mandatory for manifest & BL.
Permanent Account Number (PAN) of Notify Party (Indian entity) is mandatory
- Cargo Invoice value is currently OPTIONAL on Manifest and NOT NEEDED ON OBL
Sea Departure Manifest (SDM) – For all exports from India:
- Mandatory rule of Departure Manifest must be submitted to India Customs Prior Sailing of vessel from Port of Loading in India
- Applied for all containers loaded on said vessel at Indian Ports
- Customers have to submit shipping instruction at least 48 hours prior arrival of the vessel at POL.
- Customers have to submit shipping bills at least 42 hours before gate in of containers.
Permission for manifest revise after submission
For Sea Arrival Manifest (SAM):
- On long haul voyage more than 4 days – Before 48 hours of expected arrival.
- On medium haul voyage 2 to 4 days – Before 24 hours of expected arrival.
- On short haul voyage less than 2 days – Before 6 hours of expected arrival.
- Carrying break-bulk cargo irrespective of their voyage duration up to entry inward.
For Sea Departure Manifest (SDM):
- In general not later than 24 hours after departure.
- In respect of vessels carrying break-bulk cargo not later than 72 after departure
Remark: above timelines are to Indian customs. All requests are subject to the acceptance of ESL by evaluating the internal and external amendment process with customs approval.
House BL (HBL) Filing arrangement
- Deadline for submission of house BLs by forwarders in India should be 72 hours prior departure of the vessel at last foreign port.
- DPD, DPD/CFS, switch details to be informed to the carrier by local forwarders or consignees prior departure of the vessel at last foreign port.
