Subject: India Regulatory Change – Sea Cargo Manifest and Transshipment Regulations (SCMTR) – 12^th Update of Extension

Central Board of Indirect Taxes and Customs (CBIC) has given monthly circular for consecutive extension on the effective of Sea Cargo Manifest and Transshipment Regulations (SCMTR).     We will provide further notice until significant changes or updates.     Parallel Run is continued per below and please provide full support for timely Shipping Instruction.

Implementation

1. Mandatory Filing Requirements on Parallel Basis for SAM and SDM to be continued.
2. Fine tuning of new system and new process is in progress before effective.
3. Penalties varying from INR 50,000 to INR 200,000 will be imposed for any incompliance on or after the launch.

Sea Arrival Manifest (SAM) – For all containers into India:

1. SAM to be filed in customs before vessel getting departed from Last Foreign Port of call. Example of proforma schedule of KCIS & CIVS westbound, Port Klang is the last foreign port of call.     For GIA northbound, Dar Es Salaam is the last foreign port of call.
2. Shipping Instruction must be provided at least 72 hours before departure of last foreign port of call, or SI Cut off time provided by our POL office per local practice.
3. For ALL containers discharging for local or transhipment or retain on board at any Indian Ports.
4. Harmonized (HS) Code of 6 digits is mandatory. Only one major HS code per container is required.
5. IEC Code, GSTIN Number and email address for Indian entity is mandatory for manifest & BL.
6. Permanent Account Number (PAN) is mandatory for Indian Forwarder or NVOCC.
7. The local legal identification is required wherever an Indian party is involved (as Shipper, Consignee or Notify party).
8. Cargo Invoice value is currently OPTIONAL on Manifest and NOT NEEDED ON OBL

Sea Departure Manifest (SDM) – For all exports from India:

1. Mandatory rule of Departure Manifest must be submitted to India Customs Prior Sailing of vessel from Port of Loading in India
2. Applied for all containers loaded on said vessel at Indian Ports
3. Customers have to submit shipping instruction at least 48 hours prior arrival of the vessel at POL.
4. Customers have to submit shipping bills at least 42 hours before gate in of containers.
5. Shipper IEC Code is required for SDM filing.

Permission for Manifest Revise after submission

For Sea Arrival Manifest (SAM):

1. On long haul voyage more than 4 days – Before 48 hours of expected arrival.
2. On medium haul voyage 2 to 4 days – Before 24 hours of expected arrival.
3. On short haul voyage less than 2 days – Before 6 hours of expected arrival.
4. Carrying break-bulk cargo irrespective of their voyage duration up to entry inward.

For Sea Departure Manifest (SDM):

1. In general, not later than 24 hours after departure.
2. In respect of vessels carrying break-bulk cargo not later than 72 after departure

Remark: above timelines are to Indian customs.  All requests are subject to the acceptance of ESL by evaluating the internal and external amendment process with customs approval.      Customs amendment charge is subject to final decision by customs.

House BL (HBL) Filing arrangement

1. Deadline for submission of house BLs by forwarders in India should be 72 hours prior departure of the vessel at last foreign port.
2. DPD, DPD/CFS, switch details to be informed to the carrier by local forwarders or consignees prior departure of the vessel at last foreign port.
