Clauses on Bill of Lading: As per ESL guidelines.
Issuance of Bill of Lading:
Issuance of BL is governed by the regulations set out by The State Bank of Pakistan and Pakistan Customs.
Mandatory Documents required for Issuance of Bill of Lading are as follows:
- Goods Declaration – Shipping Instructions should be in accordance with the GD filed by the shipper with customs. All information, especially Shipper, Consignee, Cargo description, weight, Packages should match the GD filed by shipper with customs.
- Bank Documents – These are necessary documents issued by the shipper’s bank to be submitted to the Carrier / Shipping Company for issuance of Bill of Lading. These documents are;
- Authority Letter- Issued by shipper’s bank authorizing shipper or is representative to collect Bill of Lading from the carrier, Shipping Company.
- No Objection Certificate (NOC)- Issued by the bank allowing the carrier, shipping company to make out Bill of Lading/Consign the Bill of Lading, in favor of a concern / company other than the local Pakistani bank with which shipper has filed Electronic Form E (EFE).
- Form E Certificate- Required in case of C&F CIF, Freight Prepaid shipment.
(Note: Above documents issued by the bank are required to be submitted to the carrier/shipping company at the time of collection of Bill of Lading.)
- Copies of Goods Declaration (GD), Packing List, Commercial Invoice.
Import:
- To Order BL are acceptable, provided that the actual receiver’s/importer’s details in Pakistan, including full name, address, and telephone/fax number, must be manifested as the first notify party.
- Foreign consignee details are not acceptable in customs manifest. In cases where the BL is consigned to the order of a bank or a third party that is not the actual receiver/importer, the actual receiver/importer of the cargo in Pakistan must be declared as the notify party.”
- In case of a Personnel Effects shipment, Name of the passenger / the owner of the cargo who is travelling to Pakistan should be declared as the consignee.
- Deadlines to file manifest with Customs are 72 hours for long transit and 48 hours for short transit, such as to Mundra, Jebel Ali, and Sohar.
Bill of Lading Clause:
- For Cargo in Transit Via Pakistan to another country by Road/Rail such as Afghanistan, Uzbekistan, Azerbaijan, Complete details of actual consignee / receiver of goods in the destination country to be declared in consignee column of the BL. Remarks “Cargo in Transit to (name of city, country of final destination) on a/c consignee’s cost, risk & responsibility. Carrier’s responsibility ceases at POD” to be clearly mentioned in the body of the BL. Exit Point from Pakistan to be mentioned in the body of the BL.
- For Live Reefer containers, Reefer settings including Set Temp, Vent settings, humidity etc., must be clearly indicated on the BL & Manifest
Special Requirements:
- Mandatory to affix bullet/bottle seals for all Pakistan discharge containers. Noncompliance will result in heavy fines which will be on a/c of POL.
- Import of Raw Cotton and DG cargo, advance notice is required at least 5 days prior to arrival of cargo from the last transshipment port. Noncompliance may result in severe consequences for the carrier from the Department of Plant Protection & Quarantine.
Special Customs Regulations:
- Import Manifest must be submitted to Customs Authorities 24hrs prior to the vessel’s arrival, hence discharge manifests for all containers for Karachi discharge should be finalized and available in GENESIS at least 48 hours prior to arrival of Vessel.
- Dummy BLs not accepted.
- Non-Manifested containers with Pakistan Customs will not be allowed to be discharged. These containers will be retained on board for port of origin on a/c of POL/Manifesting Agency.
- All inbound containers into Pakistan to have Packing List & Commercial Invoice Pasted on the inner side of container door (Pls inform all Shipper’s as this is shipper’s responsibility not carrier’s) prior to shipment.
- S. Code is compulsory to be declared on the BL.
- In the case of a Personnel Effects shipment, a passenger is allowed to bring along with him only one car on a single visit, hence please ensure to book / manifest only one car per consignee / passenger on a BL in case of a personal effect shipment.
Corrections & Amendments:
- Deadline- 48 hours before the vessel’s arrival.
- All amendments after passage of deadline may be subject to customs approval, fines (receipted/un receipted) and possible Show Cause Notice to our Company by the Pakistan Customs Authorities.
- Changes in Consignee/notify name & addresses in Customs manifest after arrival of vessel depend entirely on customs discretion whether to allow or disallow the request. Very heavy fines, non-receipted expenses and subject to unspecified time for getting it approved or to know the final decision regarding / approval or rejection.
- Change of Consignee from a Pakistani concern to a consignee in a foreign country or vice versa is not allowed. Example. Change required in Consignee from ABC Industries, Karachi Pakistan to XYZ traders, Kabul, Afghanistan is not allowed and vice versa.
- Change of Destination of cargo or Status (from CY to CFS or vice versa) is not allowed once cargo has been discharged.
- Non-Manifested containers will not be allowed to be discharged from the vessel and will be retained on board including both Full and Empty containers.
